This Indenture dated 1617, is the one where Matthew Haige sells his interest in the Manor of West Haigh to Godfrey Matthewman.

West Haigh is sometimes referred to as Old Haigh and Nether Haigh and was located somewhere near Kexbrough. Today there is no longer any trace of its existence.


 

This Indenture made the one & thirtyeth day of Maye in the yeare of the Raigne of our sovereigne Lord James by the grace of god of England Scotland France and ireland kinge defender of the faith etc. vizt of England France and Ireland the Fifteenth and of Scotland the Fiftieth Between Mathew Haigh of West Haigh in the county of yorke yoman on the one partye and Godfrey Mathewman of Fulston in the said county of yorke yoman on the other partye Witnesseth that the said Mathew Haigh for and in consideration of the sume of Five hundreth forty and five pounds of current english money to him by the said Godfrey Mathewman before hand paid whearof hee doth acknowledge the receipt and wherewith hee houldeth himself satisfied and thereof and of every part and parcel thereof doth cleerly acquite exonerate and disharge the said Godfrey Mathewman his heires executors administrators and assignes and every of them for ever by these presente . / hath given grannted aliened bargained sould infeoffed and confirmed and by these presente doth give grannt alien bargain sell infeoffe and confirme unto the said Godfrey Mathewman his heires and assignes for ever / All that manor manor house capitall messuage or tenement comonly called Westhaigh lyeing and beeinge in Kexbrough in the said county of yorke now in the tenure or occupation of the said Mathew Haige or his assignes with all houses edifices and buidings thereunto beloninge and all seelinge glasse dores ijeste floors windowes window shutte booses hecke and yate and all to the crosse feilds orchards gardens lands tenements closes medowes feedinge pastures leasowes woods underwoods rente revertons service courte and perquisite of court rialties wards mariage releasse eschete goods and chattels of felons fugitives and outlawes profite comodities emoluments and hereditaments whatsoever to the said manor manor house capitall messuage or tenement and premisses and every or any of them belonginge or appertayninge or therewith all occupied or inioyed as parte parcell or member thereof And all comons and comon of
pasture and liberty within and upon the mores wastes and comons of Westhaigh Bretton and Woolley in the said county or elswheare in the said county to the said manor manor house capitall messuage or tenement and premisses or any of them belonginge or appertayninge or therewith all accupied or injoyed as part parcell or member thereof And also all that those of arrable land medowe or pasture sott lyeinge and beeinge in Woolley at haigh more field comonly called Morehouse Inge with a cotage or house thereupon builded with all waies waters comons profites
comodities emoluments and hereditaments to the said close and cotage and premisses belonging or in anyewise appertayninge or to or with the same occupied or inioyed as parte parcell or member thereof, And all other the lands tenements and hereditaments of the said Mathew Haigh in Kexbrough Westhaigh Bretton and Woolley in the said county of yorke and in every
or any of them with the reverton and revertons of all the said premisses and all rentes reserved upon any demis or demisses thereof or of anye parte or parcell thereof with all evidences
writings thereof deeds escriptes and mimmente whatsoever concerninge the said premisses or any parte or parcell thereof which the said Mathew Haigh or any other by his appointment or delivery now have or hath in his or theire custody to bee delivered to the said Godfrey mathewman his heires or assignes upon reasonable request thereof to the said Mathew Haigh his heires or assignes / To have and to hould the said manor manor house capitall messuage or tenement called Westhaigh houses edifices buildings toftes crofts orchards gardens foulds laudes tenementes those medowes pastures feedings leasowes comons woods underwoods rentes revertons services and all other the said premisses with theire and every of theire appurtenances before by these presente memones to bee given grannted bargained and sould as aforesaid and every parte and parcell thereof to the said Godfrey Mathewman his heirs and assignes for ever to the onely use and behoof of the said Godfrey Mathewman his heires and assignes for ever And the said Mathew Haigh for him his heires executors administrators and assignes doth covenant promise and grannte to and with the said Godfrey mathewman his heires and assignes by these presente / That hee the said Mathew Haigh
is at the tyme of the sealinge and deliveringe hearof lawfully seized of the said manor manor house capitall messuage or tenement and all and singular other the said premisses with the appurtenance before by these presente mentioned to bee given and granted as aforesaid of agood of Inheritance in fee simple and hath good right and lawfull power & authoritye to give and grannte the same and every parte and parcel thereof as is aforesaid / And that the said Godfrey Mathewman his heires and assignes shall and may from tyme to tyme and at all tymes hearafter for ever have hould occupie and inioye the said manor manor house capitall messuage or tenement and the said close called Morehouse Inge cotage and all other the said premises with theire appurtenances and every parte and parcell thereof absolutely discharged or from tyme to tyme and at all tymes thereafter well and sufficiently saved and kepte harmeles by the said Mathew Haigh his heires executors administrators or assignes or some of them of from and dower of Elizabeth now wife of the said Mathew Haigh and of from all former bargaines sales giftes grannte estates joyntures dowers willes intayles fynes forfeitures issues amercaments rente anuyties statutes recognizances judgemente executons debts of record and all other tytles charges and incumbrances whatsoever heartofore had made comitted done or suffered or hearafter to be had made comitted done suffered by the said Mathew Haigh or by Richard Haigh his father or other of theire heires or assignes or any of them or by any other person or persons whatsoever lawfully claymeinge the said premisses or parte or parcell thereof by from or under him them or any of them. The rente and services from henceforth to become due and payable for the said premisses to the cheeffe lord or lords of the Fee or Fees thereof, and one lease of the said cotage and close
called Morehouse Ing in Woolley aforesaid heartofore made by the said Mathew haigh whearein there is not above ten yards to come and expire, And also the use occupation of all the houses buildinges orchard and garden belonginge to the said messuage or tenement and of the closes called Flatte and the Stubbinge now sowed with corne and the close called Sinderfield until the nyne and twentyth day of September next insueinge the date heareof without payeinge any rente for the same duringe the said tyme / And also the fall of all that Springe wood called deepe haigh agreed to be sould to Mathew Wentworth esquire, with such weavers and lordinges to be lefte as
agreed and covenanted in certen articles made between the said Mathew Haigh and Mathew Wentworth bef ore the daye of of the date heareof as by the same maye more at large
appeare / And also libertie for removeinge of all trees and timber felled by the said Mathew Haigh or his assignes before the daye of the date heareof untill the nyne and day of Septembe next insueinge the date hearof alwaies excepted and foreprises. / And further the said Mathew Haigh for him his heires executors and administrators doth covenant promise and grannte to and with the said Godfrey Mathewman his heires and assignes by these that hee the said Mathew Haigh Elizabeth his wife and his heires shall and will from tyme to tyme and at all tymes duringe the space of seven yeares next insueinge the date heareof uppon the reasonable request or requests and at the costes and charges in the lawe of the said Godfrey Mathewman his heires and assignes make doe knowledge execute and suffer or cause to be made done knowleged executed and suffered all and every such further reasonable acte and actes devise and devises assurance and assurances in the lawe whatsoever as by the said Godfrey Mathewman his heires or assignes or by his or theire counsell in the lawes of this realm shall bee reasonablie devised advises and requires for the further assurance and sure making and conveying of all the said premisses before by these presentes
mentoned to be given grannted bargained and sould as aforesaid and parte and parcell thereof to the said Godfrey Mathewman his heires and assignes for ever to the onely proper use and behoof of the said Godfrey Mathewman his heires and assignes for ever with warrantie against all men or without warrantie at the ellecton and pleasure of the said Godfrey Mathewman his heires and assignes or any of them. Bee yt by Fyine or Fynes Feoffement or Feoffmentes or by any other lawefull wayes or meanes whatsoever, Soe as the said Mathew Haigh Elizabeth his wife or his heires or anye of them bee not inforced to travell above the distance of thirty myles from the of theire or anye of theire aboad at the tyme of the said request or requests made for the makeinge doeing knoweledgeinge executeinge or sufferinge of the said assurances and everye or anye of them / And that all Fynes Feoffment reconeryes and other assurances hearafter to bee had made knowledged done or suffered of the said premisses before by these presentes mentoned to bee given and grannted as is aforesaid and everye parte and parcell thereof by the said Mathew Haigh Elizabeth his wife and his heires and everye or anye of them shall bee and in ure to the onelye use and behoof of the said Godfrey Mathewman his heires and assignes for ever according to the true intenete and meaninge hearof, and to noe other use intent or purpose whatsoever. / In witness whereof the partyes above named to those presente Indentures interchangeablie have sett theire handes and seales the daye and yeare first above written.
